At the annual meeting of ICSW Sweden on the 28th ofMarch 2025, Hanna Scott (PhD in social work focuson welfare rights) gave a presentation about acooperation project called the Social Rights Bureau.Hanna Scott is active within the Bureau as a part ofher teaching duties at Linköping University. In thepresentation, Hanna Scott informed the attendees atthe annual meeting about the Bureau. The text belowis a summary of her presentation.

Young people seeking asylum face many different forms of violence, including violent crime, yet their illegalization, as well as their experiences of police contact and border violence, often lead to reporting of crime not being perceived as a safe or viable option. But what are the experiences of those who, in spite of their fears, do attempt to engage with law by reporting crime? Drawing on in-depth interviews with Omid, Hussein, and Akram - three young men who have sought refuge in Sweden - this article examines their attempts to mobilize law as victims of crime at the intersection of restrictive migration controls and welfare exclusions. I argue that the legal consciousness of young people in this situation is shaped by the same legal structures that create the underlying conditions for their victimization as well as by other people's perceptions of how law operates in relation to their legal status. Relationships of trust, friendship, and support can aid engagement with the criminal justice system, yet such engagement often results in re-victimization instead of protection and a lack of meaningful remedies, reinforcing feelings of disenchantment with law.

Firewalls are clear divisions between border policing and the provision of basic social rights. They have a dual character: to ensure that no information collected with the purpose of safeguarding basic social rights should be shared for immigration control purposes; and that migrants should not be subject to immigration control when being present at, or in the vicinity, of religious, private and public institutions upholding and providing social rights. This article suggests a normative argument for firewalls in the context of social work and develops the concept theoretically as a principle practised and negotiated at different scales.

Children and young people seeking asylum on their own face violence in many forms. Little is known about how they seek protection from criminalised violence. This article is based on ethnographic research, interviews and a survey of young migrants living precariously, mostly from Afghanistan, who fled to Sweden alone when they were children, but who did not have their protection needs recognised. Through lived experiences of not reporting criminalised violence to police, the article examines how protection is further denied in the context of recent changes to the Swedish migratory and welfare regime. This article finds that young migrants often perceive non-reporting as a zero-sum strategy of survival over safety. Insecure legal status prevents young migrants from engaging the law for protection from criminalised violence. Experiences of discriminatory and violent police treatment and institutional violence forming part of trajectories of displacement reinforce the lack of protection. Strategies of silence and solidarity are used to ensure the preservation of the self, the migratory project, to protect friends, and, occasionally, perpetrators. By examining young migrants experiences of non-protection from criminalised violence, intersecting structural forms of violence become visible. These failures of protection constitute part of a continuum of violence experienced by young people seeking asylum.

Det är ovärdigt ett välfärdssamhälle att motvilligt stoppa utvisningarna tillfälligt, bara för att sedan låta människor svälta i hemlöshet eller tvingas in i exploatering för att överleva i Sverige, skriver fem personer som arbetar med frågor som rör välfärd och migration.

I Malmö lever ett okänt antal barn och unga i papperslöshet med ett ständigt närvarande hot om utvisning genom deportation hängande över sig. FN:s allmänna förklaring om de mänskliga rättigheterna och FN:s barnkonvention ålägger uttryckligen stater att garantera grundläggande rättigheter för barn, oavsett legal status. Det innebär att barn utan laglig rätt att vistas i landet måste garanteras tillgång till de rättigheter som föreskrivs här och nu, men det innebär också att det behöver finnas vägar för dem och deras familjer att få en mer reguljär tillvaro i Sverige. Just deras utvisningsbarhet (se Sager, Holgersson och Öberg, 2016), den ständiga rädslan och osäkerheten, påverkar allvarligt deras rätt till liv och utveckling, inklusive barnets fysiska, mentala, andliga, moraliska, psykologiska och sociala utveckling (UNCRC, 2003). Syftet med det här kapitlet är att diskutera hur brandväggsprincipen – åtskiljandet mellan tillhandahållandet av rättigheter och inre gränskontrollarbete – kan bidra till att papperslösa barn i större grad kan tillgodogöra sig sina rättigheter i Malmö. Vi som skriver det här kapitlet har alla genom praktiskt socialt arbete och forskning följt många barn och unga som lever i papperslöshet. I texten utgår vi ifrån både våra egna erfarenheter liksom barnen och de ungas berättelser när vi diskuterar brandväggsprincipen som en metod för att säkra tillgång till grundläggande mänskliga rättigheter. I det följande ger vi först en bakgrundsbeskrivning av utvecklingen i Malmö under de senaste åren och diskuterar därefter brandväggsprincipen. Denna princip används sedan för att analysera två händelser i Malmö som belyser hur papperslösa barn under senare år fått allt svårare att tillgodogöra sig sina rättigheter. Händelserna visar på vikten av att inte bara tillgodose papperslösa barn och ungas rättigheter, utan att också praktikerna genom vilka dessa rättigheter tillgodoses – och platserna som möjliggör detta – skyddas från gränspolisens arbete. Vi avslutar kapitlet med en diskussion om vilka konsekvenser brandväggsprincipen kan ha för rättighetsarbete med barn i papperslöshet som bor i Malmö.

Stora kommunala skillnader gör gymnasielagen för unga nyanlända till ett lotteri. Och många ungdomar har dragit en nitlott. Men de allvarligaste bristerna går att åtgärda inom rimlig tid, skriver juristerna Hanna Scott och Anders Roos.
